This standalone policy applies to driver-owners, employed drivers and fleet operators participating in the MyKargoLink platform.

1. Purpose

The purpose of this Policy is to establish the standards of professional conduct, operational safety, compliance and ethical behaviour expected of all Driver-Owners, Drivers and Fleet Operators participating in the Mykargolink platform.

This Policy also explains how Mykargolink collects, uses, stores and processes personal data and operational information, including GPS and telematics data, to safely and efficiently manage transport operations.

Compliance with this Policy is a mandatory condition for participation in the Mykargolink platform.

4. Professional Conduct

Drivers shall:

  • Treat customers professionally.
  • Respect fellow road users.
  • Follow lawful instructions issued by Mykargolink dispatch personnel.
  • Wear appropriate personal protective equipment where required.
  • Keep vehicles clean and presentable.
  • Protect confidential customer information.
  • Report operational issues honestly.
  • Maintain professional communication at all times.

Drivers shall not:

  • Use abusive language.
  • Harass customers or colleagues.
  • Discriminate against any person.
  • Demand unauthorised payments.
  • Misrepresent freight information.
  • Falsify documents.
  • Divert allocated loads.
  • Engage in theft or fraud.

5. Safety Responsibilities

Every Driver shall:

  • Conduct a pre-trip inspection before every journey.
  • Ensure the vehicle is roadworthy.
  • Secure cargo correctly.
  • Obey all traffic laws.
  • Wear seat belts at all times.
  • Ensure passengers, where authorised, wear seat belts.
  • Observe speed limits.
  • Drive defensively.
  • Stop immediately if the vehicle becomes unsafe.
  • Report defects before commencing travel.

6. Fitness for Duty

Drivers must report for duty physically fit, mentally alert, properly rested, free from alcohol, free from illegal drugs, and free from impairing medication unless medically authorised and disclosed.

Mykargolink reserves the right to require alcohol or drug testing where permitted by law or where reasonable grounds exist to suspect impairment.

7. Fatigue Management

  • Take legally required rest breaks.
  • Avoid excessive driving hours.
  • Immediately notify Dispatch if fatigue affects safe driving.
  • Never falsify driving hours.
  • Safety takes priority over delivery schedules.

8. Vehicle Care

Drivers are responsible for:

  • Daily vehicle inspections.
  • Tyre condition.
  • Brake checks.
  • Oil and coolant levels.
  • Lights and indicators.
  • Mirrors.
  • Fire extinguishers.
  • Emergency triangles.
  • Vehicle cleanliness.

Drivers shall immediately report:

  • Mechanical faults.
  • Fluid leaks.
  • Tyre damage.
  • Electrical faults.
  • Warning lights.
  • Safety defects.

9. Customer Service

Drivers represent Mykargolink.

  • Arrive punctually.
  • Follow customer site rules.
  • Protect customer property.
  • Obtain proof of delivery.
  • Maintain courteous behaviour.
  • Escalate disputes to Dispatch.
  • Do not negotiate freight rates directly with customers introduced by Mykargolink.

10. Freight Security

  • Protect cargo.
  • Verify cargo before departure.
  • Prevent unauthorised access.
  • Report shortages immediately.
  • Follow seal procedures where applicable.
  • Never tamper with cargo.

11. Use of Mobile Devices

Drivers shall not text while driving, use handheld mobile phones while driving, or watch videos while operating vehicles.

Hands-free communication should only occur where lawful and safe.

12. GPS Monitoring

To ensure safety, operational efficiency, customer service and regulatory compliance, all vehicles operating on the Mykargolink platform may be equipped with GPS tracking devices, telematics systems or other approved fleet management technology.

Drivers acknowledge and agree that Mykargolink may monitor vehicle location, routes travelled, speed, driving hours, stops and idle time, engine performance, fuel consumption, harsh braking, rapid acceleration, cornering behaviour, vehicle utilisation, delivery performance, geofencing events and driver safety alerts.

GPS monitoring is conducted for legitimate business purposes including fleet management, driver safety, emergency response, theft prevention, customer updates, regulatory compliance, route optimisation, insurance requirements, performance reporting, fraud prevention and asset protection.

Drivers shall not tamper with, disconnect or interfere with any GPS or telematics equipment.

13. Personal Data Processing

Mykargolink is committed to protecting personal information while collecting and processing data necessary to operate a safe, efficient and compliant logistics platform.

By joining the Mykargolink platform, Drivers acknowledge and consent to Mykargolink processing personal information in accordance with applicable laws and this Policy.

  • Contact details.
  • Residential address.
  • Emergency contacts.
  • Employment and driving history.
  • Criminal or police clearance, where required.
  • Vehicle ownership documents.
  • Insurance information.
  • Banking details for payment.
  • Medical fitness information where relevant.
  • Training records.
  • Compliance records.
  • GPS and telematics information.
  • Photographs.
  • Video footage where captured by approved vehicle systems.
  • Incident reports.

14. Purposes of Data Processing

  • Driver onboarding.

15. Data Sharing

Where reasonably necessary, Mykargolink may share relevant information with trusted service providers and partners.

Information shared shall be limited to what is reasonably necessary for the intended purpose.

  • Maintenance providers.

16. Confidentiality

Drivers shall protect confidential information relating to customers, freight, pricing, routes, business strategies, technology and platform operations.

Confidential information shall not be disclosed without authorisation.

17. Incident Reporting

Drivers must immediately report:

  • Accidents.
  • Theft.
  • Hijacking.
  • Cargo loss.
  • Vehicle damage.
  • Mechanical failure.
  • Traffic violations.
  • Customer complaints.
  • Injuries.
  • Hazardous conditions.
  • Failure to report incidents may constitute serious misconduct.

18. Disciplinary Action

Failure to comply with this Policy may result in:

  • Verbal warning.
  • Written warning.
  • Suspension from the platform.
  • Removal from active dispatch.
  • Termination of commercial agreements.
  • Recovery of damages where legally permissible.
  • Referral to law enforcement authorities where criminal conduct is suspected.

19. Policy Review

Mykargolink reserves the right to amend this Policy from time to time to reflect changes in legislation, operational requirements or business practices.

The latest version shall be made available to all participating Drivers.

20. Driver Declaration

By using the Mykargolink platform, I acknowledge that I have received, read and understood the Mykargolink Driver Code of Conduct, Safety Policy, GPS Monitoring and Data Processing Policy.

I understand that participation on the Mykargolink platform requires compliance with this Policy.

I acknowledge that Mykargolink will collect and process my personal information and monitor vehicle operations through GPS and related technologies for legitimate business, safety, compliance and operational purposes.

By using the Mykargolink platform, I agree to comply with this Policy and understand that failure to do so may result in disciplinary action, suspension or termination of my participation on the Mykargolink platform.
